High Court judge Datuk Muhamad Ideres Muhamad Rapee fixed the date in chambers after hearing submissions from deputy public prosecutor Salehuddin Saidin and defence counsel Mohamed Hanif Khatri Abdulla. Mohamed Hanif was representing Ahmad Najib Aris, 28, charged with raping and murdering Ong, 28, at Jalan Klang Lama, here, between 1 am and 5 am on June 14 last year. In his 30-page submission, Mohamed Hanif said the court could not draw an adverse inference from his client's decision to remain silent in his defence because the prosecution had failed to prove its case beyond reasonable doubt. Salehuddin, who gave a 16-page submission, said the court, after ruling that there was a prima facie case against Ahmad Najib which would warrant an conviction if not rebutted, had no choice but to convict him on both counts. He said the consistent evidence of the prosecution's witnesses had not been challenged and the exhibits and documents, including Ahmad Najib's confession to the magistrate pointed only to him as the one who had raped and killed Ong. On Ahmad Najib electing to remain silent, he said: "The only logical conclusion that the court can make at this stage is that failure to give any explanation would allow the drawing of an inference that there is no explanantion and that the accused is guilty." Salehuddin was assisted by deputy public prosecutors Noorin Badaruddin and Kwan Li Sa while Mohamed Hanif, Mohamed Nadzim Ibrahim and Rosal Azimin Ibrahim appeared for the defence.
